Probate Litigation Probate litigation refers to lawsuits filed by or against a deceased’s person’s estate. Probate litigation also refers to lawsuits related to the interpretation and validity of a person’s will, and to challenges about the qualifications or capacity of the person appointed to administer the deceased’s estate. The term does not refer to the usual and typical administration of an estate (the winding up of a deceased’s affairs and transfer of his property), but to disputed matters that are related to or arise from an estate’s administration.
